BuilderPlus is a digital platform designed primarily for the construction, building, renovation and property industries. Depending on the features available under your account, BuilderPlus may provide tools including construction project and job listings, project and lead discovery, construction cost estimating, AI-assisted estimating, drawing and plan uploads, drawing analysis and quantity information, quotation and proposal preparation, customer and contact management, contractor tools, outreach functionality, subscription services and credit-based services.

BuilderPlus provides technology and information tools. Unless expressly stated otherwise, BuilderPlus is not a building contractor, architect, structural engineer, quantity surveyor, building control body, planning consultant, employer, recruitment agency or party to construction contracts entered into between users and third parties.

You must be at least 18 years old and legally capable of entering into a binding agreement to use BuilderPlus.

When registering an account, you agree to provide accurate, current and complete information. You are responsible for maintaining the confidentiality of your login credentials, all activities carried out through your account, ensuring authorised employees or team members comply with these Terms, keeping account information accurate and informing us promptly if you suspect unauthorised access. You must not share your account with unauthorised persons or circumvent subscription, user or credit restrictions.

BuilderPlus may display construction opportunities, project listings, customer enquiries, tender information, planning-related information or other potential business opportunities. Information may originate from customers, users, public information, third-party providers or other permitted sources.

BuilderPlus does not guarantee that a project is still available, a customer will respond or appoint a contractor, the stated value or budget is correct, contact information is accurate, a project will proceed, planning permission will be granted, the description is complete, a lead will result in paid work or any particular number or value of projects will be available. Users must carry out their own checks before committing resources. Purchasing access to a lead, project or contact does not guarantee that you will win the work.

Unless explicitly stated otherwise, any contract for construction work is entered into directly between the contractor and customer. BuilderPlus is not automatically a party to that contract.

Users are responsible for agreeing the scope of works, contract price, VAT, deposits, payment schedules, programme, materials, warranties, insurance, planning permission, Building Regulations, Building Control requirements, health and safety, site conditions, variations, completion standards and dispute resolution. BuilderPlus is not responsible for payment disputes, defective workmanship, project delays, cancellations or disagreements arising from contracts between users and third parties.

BuilderPlus may generate construction cost estimates using software, algorithms, artificial intelligence, stored pricing information, uploaded documents and information provided by users. All estimates are indicative only.

Construction prices can vary considerably according to location, labour rates, material prices, project complexity, site access, existing building conditions, specification, structural requirements, ground conditions, VAT, waste and disposal, subcontractor pricing, market conditions and other project-specific circumstances. Users must independently review and verify estimates before submitting quotations, signing contracts, ordering materials or commencing work.

AI-generated information may include cost estimates, quantities, work descriptions, suggested scopes, proposal wording, drawing interpretations, project summaries, recommendations and other generated information. Artificial intelligence can make mistakes, so AI-generated information must be reviewed by a suitably competent person before being relied upon.

You must not rely solely on BuilderPlus AI for decisions relating to structural safety, Building Regulations compliance, fire safety, electrical safety, gas safety, planning compliance, engineering, legal obligations, contractual commitments, final construction quantities or other safety-critical or regulated work. BuilderPlus does not replace professional advice.

Users may be able to upload architectural drawings, Building Regulation drawings, structural drawings, specifications, photographs, bills of quantities, schedules of work, customer documents and other project information. You confirm that you have the necessary rights and permissions to upload and process these materials.

You must not upload material that infringes intellectual property rights, contains unlawful content or malicious software, breaches confidentiality obligations or contains personal information that you have no lawful right to process. BuilderPlus may process uploaded information to provide the requested Services.

Any measurements, quantities, dimensions or take-offs produced by BuilderPlus are intended to assist users and must be independently checked. Drawing scale, drawing quality, missing information, revisions, hidden construction details and interpretation errors can affect results.

Users remain responsible for confirming quantities before ordering materials, pricing work, employing subcontractors, entering contracts or starting construction. BuilderPlus accepts no responsibility for losses resulting solely from a user's failure to verify automatically generated quantities.

BuilderPlus may allow users to create quotations, estimates, proposals or related documents. These documents are tools to assist users. The user remains responsible for checking customer information, project information, scope, quantities, prices, VAT, exclusions, payment terms, programme, legal wording and contractual commitments. Creating a quotation through BuilderPlus does not mean BuilderPlus approves, guarantees or becomes a party to that quotation.

Contractors using BuilderPlus are responsible for maintaining any licences, qualifications, registrations and insurance required for the work they undertake, including where applicable Public Liability Insurance, Employers' Liability Insurance, Professional Indemnity Insurance, Gas Safe registration, electrical certification, F-Gas certification, competent-person registrations, health and safety compliance and other trade-specific qualifications. BuilderPlus does not guarantee the competence, financial standing, qualifications or suitability of any user unless expressly stated.

Users are responsible for conducting appropriate due diligence before accepting work. This may include visiting the property, confirming the customer's identity and authority, checking drawings and measurements, checking planning status and Building Regulations requirements, inspecting site conditions, checking access, confirming payment arrangements and entering into an appropriate written contract. BuilderPlus should not be treated as a substitute for normal commercial due diligence.

Some BuilderPlus Services may require a paid subscription. The applicable subscription price, billing frequency, included features, usage allowances and renewal terms will be displayed when purchasing the subscription. Where recurring billing applies, your subscription may renew automatically until cancelled in accordance with the cancellation terms presented at purchase. Prices may change from time to time and, where required, we will provide reasonable notice before changes apply to an existing subscription.

Certain BuilderPlus features may operate using credits. Credits may be required for activities such as accessing project information, unlocking contacts, generating estimates or using premium features. The number of credits required will normally be shown before the relevant transaction.

Unless otherwise required by law, credits have no cash value, cannot be transferred between unrelated accounts, cannot be exchanged for cash and used credits are generally non-refundable once the relevant service or information has been supplied. BuilderPlus may introduce, change or discontinue credit-based features.

Payments may be processed by third-party payment providers. By purchasing a subscription, credits or another paid service, you authorise the applicable charges and are responsible for providing valid payment information. Prices will state whether applicable taxes such as VAT are included or excluded. BuilderPlus does not store full payment-card details where payments are handled directly by an authorised payment processor.

Cancellation and refund rights depend on the service purchased and whether the user is acting as a consumer or business. Where mandatory consumer cancellation rights apply under UK law, those rights will not be excluded by these Terms. For business users, fees already charged are generally non-refundable unless required by law, BuilderPlus agrees otherwise or the relevant paid Service was not supplied due to a fault attributable to BuilderPlus. Cancellation normally prevents future renewals but does not automatically refund amounts already paid.

BuilderPlus may apply reasonable usage limits to protect Platform performance and prevent abuse. Users must not excessively scrape the Platform, circumvent credit systems, create multiple accounts to avoid charges, resell Platform data without permission, attempt unauthorised access, reverse engineer protected parts, introduce malware, interfere with Platform security or use BuilderPlus for fraudulent or unlawful purposes.

You must use BuilderPlus lawfully and professionally. You must not submit false project information, misrepresent qualifications, impersonate another person or business, send unlawful or abusive communications, conduct fraud, violate intellectual property rights, distribute malware, harass customers or contractors, conduct unlawful marketing or engage in activities prohibited by UK law. We may investigate suspected misuse.

BuilderPlus may provide tools that assist users in contacting potential customers or managing outreach. Users are responsible for ensuring that their communications comply with applicable laws and regulations, including requirements relating to privacy, electronic marketing and direct marketing. BuilderPlus does not guarantee responses or business resulting from outreach.

BuilderPlus and its underlying software, branding, interface, databases, designs, workflows and proprietary technology are owned by or licensed to BuilderPlus. Except where permitted by these Terms, users may not copy, reproduce, distribute, sell, reverse engineer or commercially exploit BuilderPlus intellectual property without written permission.

You retain ownership of content that you own and upload to BuilderPlus. You grant BuilderPlus a limited licence to host, process, reproduce and technically use that content as reasonably necessary to provide, maintain, secure and improve the Services. You remain responsible for ensuring you have permission to use uploaded content.

We aim to provide a reliable service but cannot guarantee uninterrupted availability. BuilderPlus may occasionally be unavailable because of maintenance, updates, server failures, third-party service interruptions, internet outages, cybersecurity incidents or circumstances outside our reasonable control. We may modify or update Platform functionality as the Service develops.

BuilderPlus may integrate with third-party services including payment providers, artificial intelligence providers, analytics platforms, communication services or other software. Third-party services may be governed by their own terms and privacy policies. BuilderPlus is not responsible for third-party services outside our reasonable control.

BuilderPlus does not guarantee a minimum number of leads or projects, customer responses, successful quotations, contracts, revenue, profit, conversion rates or business growth. Business results depend on many factors outside BuilderPlus's control.

Nothing in these Terms excludes liability that cannot legally be excluded, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Subject to applicable law, BuilderPlus will not be responsible for indirect or consequential losses including loss of profits, contracts, opportunities, anticipated savings, goodwill, business interruption or loss resulting from inaccurate user-provided information.

For business users, where legally permitted, total aggregate liability arising from the Services will not exceed the total amount paid by that user to BuilderPlus during the 12 months immediately preceding the event giving rise to the claim. This limitation does not apply where liability cannot lawfully be limited.

BuilderPlus processes personal information in accordance with applicable UK data-protection legislation. Details about information collected, purposes of processing, legal bases, data sharing, retention, international transfers, cookies and user rights should be explained separately in the BuilderPlus Privacy Policy and Cookie Policy.

We may temporarily suspend or restrict an account where reasonably necessary because of suspected fraud, security concerns, non-payment, abuse, serious or repeated breaches of these Terms, unlawful activity or risk to BuilderPlus, its users or third parties. Where appropriate, we will provide notice and an opportunity to resolve the issue.

Users may stop using BuilderPlus and may cancel subscriptions through the available account or billing controls. BuilderPlus may terminate an account for serious or repeated breaches of these Terms. Termination does not remove payment obligations that arose before termination.

We may update these Terms to reflect changes to BuilderPlus, new features, legal requirements, security requirements or changes to our business model. Material changes will be communicated where reasonably required. Continued use of BuilderPlus after revised Terms become effective constitutes acceptance where legally permitted.

Nothing in these Terms affects statutory rights available to consumers under applicable UK law. Where a provision conflicts with a mandatory consumer right, the mandatory legal right will apply.

These Terms are governed by the laws of England and Wales. For business users, the courts of England and Wales will have exclusive jurisdiction over disputes relating to these Terms. Consumers retain any mandatory jurisdictional rights available under applicable law.

If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue in effect.

These Terms, together with any applicable subscription terms, Privacy Policy, Cookie Policy and other expressly incorporated policies, form the agreement governing use of BuilderPlus.
